Terms of Service

These Terms of Service ("Terms") govern your use of Thirrsty.com and its mobile/PWA applications (the "Service"), operated by Banks Class LLC ("we", "us", "our"). By creating an account or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create a Thirrsty account. Some venue features require you to be 21+ where alcohol is served. By signing up, you represent that you meet the applicable age requirement in your jurisdiction.

2. Your Account

• You are responsible for safeguarding your password and for all activity under your account.
• You agree not to share, sell, or transfer your account to anyone else.
• You agree to provide accurate information at signup and keep it up to date.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent or harmful.

3. User-Generated Content

You retain ownership of the posts, stories, photos, videos, and other content you publish ("Your Content"). By posting Your Content you grant Banks Class LLC a worldwide, royalty-free, non-exclusive license to host, display, and reproduce it solely to operate and promote the Service.

You will not post content that:

• Is illegal, defamatory, obscene, sexually explicit, hateful, harassing, or violent.
• Promotes underage drinking, drug abuse, or other illegal activity.
• Infringes anyone else's intellectual property, privacy, or publicity rights.
• Contains spam, scams, phishing, or malicious code.
• Impersonates another person, business, or venue.

We may remove content that violates these Terms at our discretion, and we may report unlawful content to law enforcement.

4. Venue Discounts & QR Codes

Discounts shown in the app are offered by partner venues, not by Thirrsty. Banks Class LLC is not responsible for venue pricing, availability, or policies. Always verify the discount with venue staff before purchasing. Thirrsty QR codes are personal — sharing or duplicating your QR may result in account termination.

5. Venue Subscriptions

Venue owners may subscribe to the Local or National plan to list their venue. Subscription fees are billed in advance and are non-refundable except where required by law. You may cancel anytime; cancellation takes effect at the end of the current billing period.

6. Acceptable Use

You will not:

• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use automated bots, scrapers, or crawlers to access the Service.
• Resell, rent, or sublicense access to the Service.
• Interfere with or disrupt the Service or its security.
• Use the Service to send spam or unsolicited messages.

7. Intellectual Property

The Thirrsty name, logo, design, code, content (other than user-generated content), and trademarks are owned by Banks Class LLC. You may not use them without our prior written permission.

8. Termination & Account Deletion

You may delete your account at any time from Profile → Danger zone → Delete account. We may suspend or terminate your account if you violate these Terms or if we reasonably believe your conduct creates risk for Thirrsty, our users, or partner venues. Upon termination, your right to use the Service ends immediately.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by law, Banks Class LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of the Service. Our total liability for any claim is limited to the greater of $100 USD or the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Banks Class LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from Your Content, your violation of these Terms, or your misuse of the Service.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law principles. Any dispute will be resolved through binding arbitration in Baltimore, Maryland, under the rules of the American Arbitration Association — except either party may bring a small-claims action in the proper court.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the app, and the new effective date will be posted at the top. Continued use after the changes means you accept the revised Terms.
